This Privacy Policy explains how BurnSong (“BurnSong,” “we,” “our,” or “us”) handles personal information in connection with our website at burnsong.com (the “Site”), the free account through which listeners access our streaming audio, and the other online interactions we offer — including email communications and our optional SMS program (together, the “Services”).
BurnSong is an independent sound studio that designs binaural beats, focus music, and guided concentration sessions for general wellness, productivity, and entertainment use. Our audio is delivered exclusively through streaming on the Site after you create a free BurnSong account. Using the Services means you have read this Policy and agree to its terms. If you don't agree, please don't use the Services or submit personal information through them.

II. Scope of This Policy
This Policy covers the Services we control and operate. It does not apply to:
- Independent websites, mobile apps, or platforms we may link to from the Site;
- Third-party streaming services, podcast platforms, app stores, or distribution partners through which you may separately encounter BurnSong audio under their own terms;
- Retailers, marketplaces, or payment pages operated by other companies that you reach through our links or promotions; or
- Any services offered by our partners under their own branding and terms.
Before interacting with a third-party destination, we recommend reviewing the privacy practices posted on that destination.
III. A Note About Our Audio Content
BurnSong binaural beats, focus music, and guided concentration sessions are designed for general wellness, productivity, and entertainment purposes only. Our audio content is not a medical device, not a clinical treatment, and not a substitute for advice from a qualified healthcare professional.
BurnSong is not a medical, clinical, or mental-health provider. Please do not send us protected health information, diagnoses, clinical records, or similar sensitive medical data through our forms, account profile, emails, or SMS channels. Our Services are not designed to collect or safeguard information governed by HIPAA.
IV. Categories of Information We Collect
For purposes of this Policy, “personal information” means any information that identifies, relates to, or could reasonably be linked to a specific person or household. We group the personal information we collect into five buckets.
A. Account Information
Because streaming on BurnSong requires a free account, the first category of personal information we typically collect is the information you supply at sign-up and maintain on your profile. This may include:
- Login credentials, including your email address and a password (which we store in hashed form — we never store your plain-text password);
- Account profile details such as your display name, time zone, preferred language, and notification settings;
- Optional profile information you choose to add, such as the types of sessions you gravitate toward (deep focus, sleep, meditation, study, creative flow) or target session lengths;
- Account status information, including whether your account is active, suspended, or deactivated, and any history of sign-ins from new devices.
B. Listening and Playback Activity
When you stream audio on the Site while signed in, our systems record playback activity that helps us deliver the service, remember where you left off, and improve our content library. This may include:
- Which sessions, tracks, or collections you start, skip, pause, resume, or complete;
- Session duration, completion percentage, and approximate time of listening;
- Audio preferences that influence playback (for example, volume levels, EQ or balance settings, and any session-level customizations you apply);
- The device and network characteristics of the browser or device that streamed the audio (see also Section IV.D).
We use this information primarily to operate the streaming experience, prevent abuse of the service, and understand, in aggregate, which kinds of sessions resonate with listeners.
C. Other Information You Provide
Outside of account sign-up, you may choose to give us additional information, such as:
- Your mobile phone number, if you voluntarily opt in to the BurnSong SMS program (see Section VIII);
- Messages you send through our contact forms, support channels, or listener feedback prompts;
- Survey responses, beta-program sign-ups, or entries in any contest or giveaway we may run.
D. Information Gathered Automatically
When you browse the Site, stream audio, or interact with our messages, our systems may log:
- Technical identifiers (IP address, device type, operating system, browser version, screen size);
- Engagement data (pages you load, links you click, time on page, scroll behavior, referring URLs, dates and times of visits);
- Streaming diagnostics (connection quality, buffering events, audio format served, CDN region);
- General geographic signals (such as city- or region-level location derived from your IP address — not precise GPS coordinates).
E. Cookies and Similar Technologies
Like most websites, the Site uses cookies, SDKs, tracking pixels, web beacons, local storage, and comparable tools. These help us keep you signed in, remember your playback preferences, measure performance, and deliver marketing.
You can normally manage cookies through your browser's privacy controls and through device-level settings. Turning off certain cookies may cause parts of the Site — including sign-in and streaming — to stop working as intended.
V. How We Obtain Personal Information

- You voluntarily subscribe to the BurnSong email list or opt in to the BurnSong SMS program;
- You browse or interact with the Site, triggering automated logging through cookies, server logs, or similar tools;
- You participate in a survey, beta, or other optional BurnSong program.
If you provide us with information about another person — for example, referring a friend or entering a friend's email on a share-the-Site prompt — you confirm that you are authorized to share that information with us for the relevant purpose.
VI. Why We Process Personal Information
We use the personal information described above for purposes such as:
- Creating and maintaining your account, authenticating sign-ins, and securing the Service against unauthorized access;

VII. When We Share Personal Information
A. We Do Not Sell Your Personal Information
BurnSong does not sell personal information in exchange for money or other valuable consideration, and we do not rent listener lists to outside marketers.
B. Disclosures to Vendors That Work on Our Behalf
We rely on trusted service providers to help us run the Services. These providers may receive personal information solely to perform tasks for BurnSong under written agreements that restrict their use of the data. Typical categories include:
- Website hosting, cloud storage, content delivery networks, and audio-streaming infrastructure;
- Identity, account, authentication, and password-reset providers;
- Analytics, A/B testing, and conversion-measurement tools;
- Email service providers and help-desk / support platforms;
- SMS platform operators, telecom aggregators, and compliance partners (used only if you opt in to the SMS program).
C. Legal, Protective, and Corporate Transactions
We may disclose personal information when we believe in good faith that doing so is necessary to:
- Comply with a law, regulation, subpoena, court order, or other valid legal process;

D. Aggregated and De-Identified Data
We may produce and share aggregated statistics, trend reports, or other de-identified data that can't reasonably be linked back to any individual.
VIII. Communications From BurnSong
BurnSong communicates with listeners through several channels. Each channel has its own sign-up, frequency, and opt-out process, and opting out of one channel does not automatically opt you out of the others.
A. Account and Service Messages
When you hold a BurnSong account, we may need to send you transactional messages — for example, email confirmations of account creation, password resets, security alerts, notifications about changes to the Services or our legal terms, and responses to support requests you open. Because these messages are necessary to operate the account, you cannot opt out of them while your account remains active.
B. Email Marketing
If you opt in to BurnSong marketing emails — typically as a separate choice at sign-up or through a sign-up form on the Site — we may send you content such as new session announcements, listener tips, studio updates, and promotional offers. Every marketing email will include an “unsubscribe” link that will stop future marketing emails to that address.
C. SMS / Text Message Program (Optional)
The BurnSong SMS program is entirely optional. Creating a BurnSong account does not enroll you in SMS; you only receive text messages from us if you separately opt in by providing your mobile number and agreeing to our SMS terms.
If you choose to enroll, the following applies:
- What we send: new session releases, subscriber-only offers on BurnSong memberships or audio, studio updates, and related content.
- Message frequency: Message frequency varies.
- Cost: Message and data rates may apply, depending on your mobile plan.
- Cancel: Reply STOP at any time to unsubscribe from the BurnSong SMS program.
- Help: Reply HELP for assistance, or email us at info@burnsong.com.
- Carrier disclaimer: Mobile carriers are not liable for delayed or undelivered messages.
Regarding the handling of mobile opt-in information, we follow wireless-carrier and messaging-industry expectations. Specifically:
- No sale or marketing-sharing of mobile data. No mobile information will be sold or shared with third parties or affiliates for their marketing or promotional purposes.
- No sharing of text-message opt-in data or consent. SMS originator opt-in data and consent will not be shared with any third parties.
To actually deliver messages, we share the minimum necessary information with vendors who operate the program (messaging platforms, aggregators, compliance monitors, carriers). These parties may use the data only to deliver, troubleshoot, secure, and lawfully operate the program on our behalf. We also retain opt-in/opt-out records to evidence consent, honor STOP requests, and meet applicable legal and carrier/CTIA requirements.
IX. Analytics and Digital Measurement
We may work with analytics partners to understand how visitors find and use the Site, how listeners engage with our audio, and how our campaigns perform. These tools can gather information like IP address, referring pages, browser properties, streaming diagnostics, and interactions with specific on-page elements.
Our analytics use is primarily aimed at measurement, not identification — we generally don't need to know who you are personally to understand aggregate trends.
X. Security of Personal Information
BurnSong maintains administrative, technical, and physical safeguards intended to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include encryption in transit, hashed password storage, access controls on our systems, and vendor diligence. No online service can guarantee complete security, however, and we therefore cannot promise that personal information will never be compromised. Please use a strong, unique password for your BurnSong account and be careful about the information you share with us and with others.
XI. How Long We Keep Personal Information
We retain personal information only for as long as reasonably needed to operate the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Typical retention patterns include:
- Account information is retained for the life of the account, plus a limited period after deactivation for security, fraud-prevention, and legal recordkeeping;
- Listening activity is retained while your account is active to power the service, then aggregated or de-identified, or deleted, on a rolling basis;
- SMS opt-in and opt-out records are retained as required by applicable law and industry standards to evidence consent and prevent re-contact after STOP;
- Support communications are retained for a reasonable period after resolution of the request.
XII. Users Under 18
The Services are designed for adults. We do not direct the Site, the account system, the email program, or the SMS program to individuals under 18, and we do not knowingly collect personal information from individuals under 18.
If you are a parent or guardian and believe that someone under 18 has created a BurnSong account or otherwise submitted information to us, please contact us at info@burnsong.com. We will take reasonable steps to close the account and delete associated information.
XIII. Privacy Rights for U.S. State Residents
Depending on the U.S. state you live in, you may have the right to make certain requests regarding your personal information. Common state-level rights include:
- Right to know / access: request details about the personal information we have about you and how we have used it;
- Right to delete: request that we delete personal information we hold about you;
- Right to correct: request correction of personal information you believe is inaccurate;
- Right to receive disclosures: request additional information about the categories of personal information we collect, use, and disclose.
A. Do Not Sell / Do Not Share
As noted in Section VII, we do not sell personal information, and as noted in Section VIII we do not share mobile opt-in data with third parties for their own marketing purposes.
B. How to Submit a Request
To exercise an available state privacy right, email info@burnsong.com using the subject line “BurnSong Privacy Request.” Please describe the right you'd like to exercise and the information necessary for us to locate your records (for example, the email address associated with your BurnSong account). We may need to verify your identity, or the identity of an authorized agent acting on your behalf, before acting on the request.
C. No Retaliation
BurnSong will not discriminate or retaliate against you for exercising any privacy right available to you.
XIV. Updates to This Privacy Policy
We may revise this Policy from time to time to reflect changes in our Services, in the law, or in how we handle personal information. When we update the Policy, we'll change the “Last Updated” date at the top of this page. For material changes, we may also notify account holders by email or through an in-Site notice. Continued use of the Services after an update means you accept the revised Policy.
