These Text Message Terms & Conditions (the “SMS Terms”) govern your use of the BurnSong text-messaging program (the “BurnSong SMS Program” or “Program”), which is operated by AmericanDream Sp. z.o.o. on behalf of the BurnSong brand (“BurnSong,” “we,” “our,” or “us”). BurnSong is an independent sound studio that designs binaural beats, focus music, and guided concentration sessions.
By signing up for the Program, replying to a BurnSong message confirming enrollment, or otherwise opting in, you agree to these SMS Terms. If you do not agree, please do not enroll in the Program, and reply STOP to any message to be removed.
1. What the BurnSong SMS Program Is
The BurnSong SMS Program is a recurring mobile-messaging program through which BurnSong sends SMS (and, where supported by your carrier, MMS) messages to the mobile phone number you provide at sign-up.
Typical messages in the Program include:
- New session releases and drops (for example, newly produced binaural beat tracks, focus music sets, or guided concentration sessions);
- Early-access or preview opportunities for upcoming audio;
- Subscriber-only promotional offers on BurnSong audio, licenses, or memberships;
- Studio updates, behind-the-scenes notes, and brand announcements;
- Customer-care replies to texts you send to our number; and
- Administrative messages related to the Program itself (for example, welcome messages, STOP confirmations, and HELP responses).
Messages from the Program are provided for informational and promotional purposes only. BurnSong audio is intended for general wellness, productivity, and entertainment use. It is not a medical device, not a clinical treatment, and not a substitute for advice from a qualified healthcare professional. Nothing sent through the Program is medical, mental-health, diagnostic, or therapeutic advice.
2. Who Can Enroll
To participate in the BurnSong SMS Program, you must:
- Be at least 18 years old (or the age of majority in your state or jurisdiction, whichever is greater);
- Be a resident of the United States, with a U.S.-based mobile phone number on a participating wireless carrier;
- Be the subscriber of the mobile phone line being enrolled, or have the express authority of the line subscriber to enroll that number; and
- Provide accurate, complete, and current information when signing up.
By enrolling, you represent and warrant that you meet each of these requirements. BurnSong may refuse enrollment, suspend, or terminate your participation at any time if we believe these requirements are not met.
3. Your Consent and How to Opt In
You can enroll in the BurnSong SMS Program in any of the ways we offer, which may include:
- Submitting your mobile number through a sign-up form on our website or landing pages;
- Providing your mobile number and opting in through another channel we make available (for example, a checkout flow, a listener survey, or an in-person event sign-up).
By opting in, you give BurnSong your express written consent to send recurring automated marketing and informational text messages to the mobile number you provide, sent using an automatic telephone dialing system or similar technology, at the frequency described below. Consent is not a condition of purchasing, downloading, or otherwise accessing any BurnSong audio or service.
After you opt in, we'll typically send a welcome message confirming your enrollment. In some flows, we may ask you to reply with a confirmation keyword (such as Y or YES) before activating your subscription.
4. Message Frequency
Message frequency varies. The number of messages you receive in a given week or month may go up or down depending on new session releases, promotional periods, and the level of your engagement with the Program.
If you'd prefer fewer messages, you can reply STOP at any time to leave the Program entirely (see Section 6).
5. Message and Data Rates
Message and data rates may apply for each message you send to us and each message we send to you through the Program. These charges depend on your mobile plan and your wireless carrier. If you're unsure what your plan covers, please check with your wireless carrier before enrolling.
BurnSong is not responsible for any charges you incur in connection with Program messages.
6. How to Cancel (STOP)
You can cancel the BurnSong SMS Program at any time. To unsubscribe, reply with the single word STOP to any BurnSong message, from the mobile number enrolled in the Program.
After we receive your STOP request, we'll send a one-time confirmation text acknowledging that you have been unsubscribed. That confirmation is the final message we'll send to that number through the Program. Following that confirmation, you will no longer receive messages from the BurnSong SMS Program at that number.
If you change your mind later, you can re-enroll using any of the sign-up methods described in Section 3, and the Program will resume.
Note: unsubscribing from the BurnSong SMS Program does not automatically unsubscribe you from our email list or other BurnSong communication channels. Each channel has its own opt-out.
7. How to Get Help (HELP)
If you're having trouble with the Program or simply have a question, reply HELP to any BurnSong message. You'll receive an automated response with basic Program information and contact details.

8. Supported Carriers
The Program is available on most major U.S. wireless carriers, including (but not limited to) AT&T, Verizon Wireless, T-Mobile, US Cellular, Sprint, Boost Mobile, Cricket Wireless, Metro by T-Mobile, Google Fi, and many smaller regional carriers and MVNOs.
Carrier participation can change without notice. If your carrier does not support SMS short-code or A2P messaging, you may not be able to enroll or may stop receiving messages. BurnSong has no control over carrier-level support or policy changes.
9. Message Delivery Disclaimer
Carriers are not liable for delayed or undelivered messages. BurnSong also cannot guarantee that every Program message will be delivered to your mobile device, or delivered within a specific time window. Delivery can be affected by carrier coverage, network congestion, device settings, international roaming, and other factors outside our control.
10. Your Responsibilities as a Subscriber
By participating in the BurnSong SMS Program, you agree that:
- You will provide a mobile number that you own or are authorized to enroll;
- You will promptly notify BurnSong if the mobile number you enrolled is reassigned, transferred, or deactivated (for example, by texting STOP from the old number, or by emailing us);
- You will not use the Program to transmit unlawful, harassing, abusive, defamatory, or otherwise objectionable content back to BurnSong;
- You will not attempt to reverse-engineer, overload, or interfere with our messaging systems or those of our service providers; and
- You are responsible for all messaging and data charges incurred by the mobile number you enroll, regardless of who physically sent or received the message.
11. Changes to the Program or These Terms
BurnSong may modify, suspend, or discontinue the BurnSong SMS Program, in whole or in part, at any time and without prior notice. We may also update these SMS Terms from time to time. When we do, we'll post the revised terms at burnsong.com and update the “Last Updated” date at the top of this page.
Your continued participation in the Program after any change means you accept the updated SMS Terms. If you do not agree with a change, please reply STOP to unsubscribe.
12. Privacy
Information submitted in connection with the BurnSong SMS Program — including your mobile number, opt-in and opt-out records, and message history — is handled in accordance with the BurnSong Privacy Policy.
As stated in our Privacy Policy: no mobile information will be sold or shared with third parties or affiliates for their marketing or promotional purposes, and SMS originator opt-in data and consent will not be shared with any third parties. We use vendors only as needed to deliver, secure, and lawfully operate the Program on our behalf.
13. Disclaimers and Limitation of Liability
The Program is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, BurnSong disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
BurnSong audio content referenced in Program messages is produced for general wellness, productivity, and entertainment purposes only, and BurnSong makes no representation or warranty that any specific session will produce any particular outcome (such as focus, relaxation, sleep, or concentration) for any particular listener.
To the fullest extent permitted by law, BurnSong, its affiliates, and its service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your participation in the Program, including (without limitation) any delayed, undelivered, or misdirected messages, or any charges imposed by your wireless carrier.
14. Governing Law
These SMS Terms, and any dispute or claim arising out of or relating to the Program, are governed by the laws of Poland, without regard to its conflict-of-laws rules, and by applicable U.S. federal law. Any action relating to the Program must be brought in the state or federal courts located in Poland, and you consent to the personal jurisdiction of those courts.
